Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Tracej ("Trace", "we", "our", "us"), the operator of the Trace service available at tracej.com and app.tracej.com (the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Tracej is the legal entity behind the Trace brand and is the counterparty for these Terms. Paid subscriptions are sold and billed by our merchant of record, Paddle.com Market Limited ("Paddle"), under the Paddle Buyer Terms, which apply to the purchase transaction in addition to these Terms.

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify you of material changes by email or in-app notice.

Trace is a trading journal application that allows users to log, track, and analyse their trading activity. The Service is provided for informational and record-keeping purposes only.

Trace does not provide financial advice. Nothing in the Service constitutes investment advice, a recommendation to buy or sell any financial instrument, or a solicitation. Trading financial instruments carries significant risk. You are solely responsible for your trading decisions.

You must be at least 18 years old to use the Service. By using Trace, you represent that you meet this requirement. The Service is not available in jurisdictions where its use would be unlawful.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at lev.tracej@gmail.com if you suspect unauthorised access.

You may not share your account with others or create accounts on behalf of third parties without their express consent. Each person using the Service must have their own account.

You may not create multiple accounts to circumvent account restrictions, free tier limits, or any other access controls.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorised access to the Service, its servers, or any other accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Scrape, crawl, or systematically download data from the Service without our written permission
• Upload or transmit malware, viruses, or any malicious code
• Interfere with or disrupt the integrity or performance of the Service
• Resell or sublicense access to the Service without our prior written consent

You retain full ownership of all trade data, notes, and content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited licence to store, process and display it solely for the purpose of providing the Service to you.

We do not claim any ownership over your User Content and will not use it for any purpose other than operating the Service.

You are responsible for the accuracy of the data you enter and for maintaining your own backups where necessary.

Tracej offers a free Basic tier and a paid Pro subscription. Paid features are clearly labelled within the Service.

Subscriptions are sold and billed monthly or annually in advance by our merchant of record Paddle.com Market Limited ("Paddle"), whose name appears on your statement and who handles applicable VAT / sales tax. All prices on the pricing page are exclusive of tax unless stated otherwise. Subscriptions automatically renew for further periods equal to the initial term until cancelled.

Refunds and statutory withdrawal rights. Refund eligibility and processing are governed by the Paddle Buyer Terms and the Paddle Refund Policy, both of which form part of your purchase. Our Refund Policy summarises those rules and the two ways you can request a refund (through Paddle directly, or through us). Statutory rights of withdrawal vary by country of residence; nothing in these Terms limits any non-waivable consumer right.

We reserve the right to change pricing with 30 days' notice for existing subscribers; new prices take effect at the next renewal. You may cancel your subscription at any time from Settings → Manage plan, or from your Paddle receipt. Cancellation takes effect at the end of the current billing period and you keep access until then.

The Trace name, logo, application design, and all software (excluding your User Content) are owned by us and protected by intellectual property law. You may not use our branding without prior written permission.

We grant you a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial trading journal purposes.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost. We recommend maintaining your own records of important trading data.

To the maximum extent permitted by law, Tracej shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or trading losses, arising out of your use of or inability to use the Service.

Our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the 3 months preceding the claim, or €100, whichever is greater.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

You may delete your account at any time from within the Service. Account deletion is permanent and irreversible.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. We will give you reasonable notice unless the violation is serious or immediate action is required.

Upon termination, your right to use the Service ceases immediately. Sections 8, 9, 10, and 12 survive termination.

These Terms are governed by the laws of the jurisdiction in which Tracej is registered. Any disputes shall be resolved in the competent courts of that jurisdiction. Where applicable mandatory consumer protection law of your country of residence grants you stronger rights, that law overrides this section.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
